Filing an Application for Divorce

Divorce Applications are filed through the Federal Magistrates Court.

Divorce Applications require a fee.

There are circumstances under which you may be excused form paying this fee. When filing the application you may submit a form detailing which of the following circumstances apply:

  • you receive a Commonwealth Government Allowance and have a Concession Card
  • you receive a student benefit AUSTUDY or ABSTUDY, or you are receiving legal aid, or
  • paying the fee would result in financial hardship
